These Terms & Conditions (“Terms”) govern your access to and use of the Pure Strike Golf website, mobile application, training programs, assessments, content, subscriptions, and related services.
Pure Strike Golf is operated by Pure Strike Golf Inc. (“Pure Strike Golf,” “Pure Strike,” “we,” “us,” or “our”).
By accessing or using Pure Strike Golf, you agree to these Terms. If you do not agree, you should not use the app, website, services, programs, assessments, subscriptions, or content.
1. About Pure Strike Golf
Pure Strike Golf is a golf fitness and performance platform designed to help golfers improve mobility, strength, movement quality, longevity, consistency, and physical preparation for golf.
The app may include training programs, exercise videos, mobility routines, strength programs, golf fitness assessments, progress tracking, educational content, push notifications, and subscription-based features.
2. No Medical Advice
Pure Strike Golf provides fitness, movement, golf performance, and educational content only.
Pure Strike Golf does not provide medical advice, diagnosis, treatment, physical therapy, rehabilitation services, or healthcare services. The content, assessments, programs, recommendations, and progress tracking features are not a substitute for advice from a physician, physical therapist, or qualified healthcare professional.
Before starting any exercise program, mobility routine, strength program, speed program, or performance protocol, you should consult with a qualified healthcare professional, especially if you have any injury, pain, medical condition, cardiovascular concern, limitation, prior surgery, or health concern.
3. Assumption of Risk
Exercise, mobility training, strength training, speed training, golf fitness, and physical activity involve inherent risks.
These risks may include, but are not limited to:
- Muscle soreness
- Strains
- Sprains
- Falls
- Joint irritation
- Back, neck, shoulder, hip, knee, ankle, or wrist discomfort
- Aggravation of existing injuries or medical conditions
- Cardiovascular stress
- Other physical injuries or complications
By using Pure Strike Golf, you acknowledge and accept these risks. You agree that your participation is voluntary and that you are responsible for using your own judgment.
Stop exercising immediately and seek medical attention if you experience chest pain, dizziness, shortness of breath, sharp pain, numbness, faintness, unusual discomfort, or any concerning symptoms.
4. User Responsibility
You are responsible for:
- Determining whether you are physically able to participate
- Using proper form and safe training judgment
- Choosing exercises appropriate for your current ability
- Modifying, skipping, or stopping exercises when necessary
- Training in a safe environment
- Using appropriate equipment safely
- Consulting a qualified healthcare or fitness professional when needed
- Providing accurate information in assessments and account settings
- Not ignoring pain, injury, or warning signs
Pure Strike Golf does not guarantee that any exercise, assessment, program, or recommendation is appropriate for every individual.
5. No Guaranteed Results
Pure Strike Golf does not guarantee specific results.
We do not guarantee improvement in golf score, handicap, swing speed, distance, strength, mobility, flexibility, pain, injury status, health, body composition, longevity, performance, or any other outcome.
Results vary based on many factors, including consistency, effort, starting ability, injury history, health status, nutrition, sleep, recovery, coaching, genetics, and other personal circumstances.
6. Age Requirement
Pure Strike Golf is intended for users who are at least 16 years old.
Users between the ages of 16 and 17 may use Pure Strike Golf only with permission and supervision from a parent or legal guardian.
By using Pure Strike Golf, you confirm that you are at least 16 years old and, if under 18, have permission from a parent or legal guardian.
7. Account Registration
Some features may require you to create an account.
You agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account login credentials and for all activity that occurs under your account.
You agree not to share your account credentials, sell access to your account, or allow unauthorized users to access your subscription.
You agree to notify us if you believe your account has been accessed without authorization.
8. Subscriptions, Free Trials, and Billing
Pure Strike Golf may offer free trials, monthly subscriptions, annual subscriptions, founding member pricing, promotional pricing, discount codes, affiliate codes, or other paid plans.
Subscription pricing, duration, features, and available offers will be shown at the time of purchase.
If you purchase a subscription through the Apple App Store, your purchase, billing, renewal, cancellation, and refund process are managed by Apple and subject to Apple’s terms and policies.
Subscriptions may automatically renew unless canceled through your Apple account settings before the renewal date.
Pure Strike Golf does not directly control Apple billing, Apple refunds, Apple renewal settings, Apple payment methods, or Apple subscription management.
9. Cancellation
You may cancel your subscription according to the cancellation method provided by the platform where you purchased it.
For Apple App Store purchases, subscriptions can typically be managed through your Apple account subscription settings.
Canceling a subscription prevents future billing but may not automatically result in a refund for past charges or unused time.
10. Refunds
Refunds for purchases made through the Apple App Store are handled by Apple according to Apple’s policies.
For purchases made directly through Pure Strike Golf, if applicable in the future, refund eligibility will be determined according to the terms provided at purchase and applicable law.
11. License to Use Pure Strike Golf
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use Pure Strike Golf for your personal, non-commercial use.
You may not:
• Copy, reproduce, distribute, sell, lease, sublicense, or commercially exploit our content
• Share, resell, or transfer your account access
• Use Pure Strike Golf content for commercial coaching, training, programming, or business purposes without written permission
• Screen record, download, copy, or redistribute app videos or program content
• Reverse engineer, modify, or attempt to extract app source code
• Interfere with the security, operation, or performance of the app
• Use the app for unlawful, abusive, misleading, or harmful purposes
• Misuse our trademarks, branding, logos, videos, programs, assessments, or intellectual property
12. Intellectual Property
All Pure Strike Golf content and intellectual property are owned by Pure Strike Golf Inc. or its licensors.
This includes, but is not limited to:
- App name
- Logos
- Branding
- Videos
- Training programs
- Exercise library
- Assessments
- Mobility protocols
- Strength programs
- Golf fitness systems
- Written content
- Graphics
- App design
- Progress tracking systems
- Scoring systems
- Educational materials
- Website content
You may not use, copy, reproduce, distribute, modify, sell, publish, or commercially exploit our intellectual property without prior written permission from Pure Strike Golf Inc.
13. User Content and Inputs
You may provide information such as assessment responses, progress logs, training notes, feedback, support messages, fitness information, wellness information, pain-related information, or injury-related information.
By submitting information to Pure Strike Golf, you grant us permission to use that information as necessary to operate, personalize, improve, support, and maintain the app and services.
You are responsible for the accuracy, legality, and appropriateness of any information you provide.
14. Future Features
Pure Strike Golf may add, modify, or remove features over time.
Future features may include photo or video uploads, community features, messaging, social features, additional tracking tools, coaching features, partner features, or other functionality.
If future features involve additional data collection, user-generated content, or community interaction, additional rules, policies, or updated terms may apply.
15. Community Features and User Conduct
If Pure Strike Golf adds community, messaging, commenting, or user-to-user features in the future, users will be expected to behave respectfully and lawfully.
Users may not post or transmit content that is abusive, threatening, harassing, defamatory, obscene, discriminatory, misleading, infringing, illegal, or otherwise harmful.
We reserve the right to remove content, restrict access, suspend accounts, or terminate accounts if users violate these Terms or misuse the platform.
16. App Availability and Changes
We may update, modify, suspend, or discontinue any part of Pure Strike Golf at any time.
We may add, remove, or change programs, features, pricing, content, assessments, subscriptions, or services as the platform evolves.
We are not liable for interruptions, downtime, errors, data loss, feature changes, or unavailability of the app or website.
17. Third-Party Services
Pure Strike Golf may integrate with third-party platforms, payment processors, subscription management tools, analytics services, hosting providers, notification services, app stores, or other technology providers.
Your use of third-party services may be subject to their own terms and privacy policies.
We are not responsible for third-party platforms, services, policies, actions, errors, outages, or billing systems.
18. Disclaimer of Warranties
Pure Strike Golf is provided on an “as is” and “as available” basis.
We do not guarantee that the app, website, programs, assessments, recommendations, subscriptions, or content will be uninterrupted, error-free, secure, accurate, complete, or appropriate for every user.
To the maximum extent permitted by law, Pure Strike Golf disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
19. Limitation of Liability
To the maximum extent permitted by law, Pure Strike Golf Inc., its owners, officers, directors, employees, contractors, affiliates, partners, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the app, website, services, programs, assessments, subscriptions, or content.
This includes, but is not limited to:
- Injuries
- Aggravation of existing conditions
- Lost profits
- Lost data
- Lost opportunities
- Subscription issues
- Billing issues handled by third-party platforms
- App downtime
- Performance outcomes
- Golf results
- Fitness results
- Health-related outcomes
To the maximum extent permitted by law, our total liability for any claim related to Pure Strike Golf will not exceed the amount you paid to Pure Strike Golf for the service during the three months before the claim arose, or one hundred dollars, whichever is greater.
20. Indemnification
You agree to defend, indemnify, and hold harmless Pure Strike Golf Inc., its owners, officers, directors, employees, contractors, affiliates, partners, and service providers from any claims, damages, liabilities, losses, costs, or expenses arising from:
- Your use or misuse of Pure Strike Golf
- Your violation of these Terms
- Your violation of any law or third-party right
- Your user content, inputs, or information
- Your physical activity, exercise participation, or training decisions
- Your account activity
- Your unauthorized use or distribution of Pure Strike Golf content
21. Termination
We may suspend or terminate your access to Pure Strike Golf if we believe you have violated these Terms, misused the platform, created risk for other users, infringed our rights, failed to pay applicable fees, or engaged in unlawful, abusive, or harmful activity.
Termination may result in loss of access to your account, subscription features, saved progress, and app content.
22. Arbitration and Dispute Resolution
Before filing any legal claim, you agree to first contact us at support@purestrikeapp.com. so we can attempt to resolve the issue informally.
To the maximum extent permitted by law, any dispute arising from or relating to Pure Strike Golf, these Terms, or your use of the app or services will be resolved through binding individual arbitration rather than in court.
You and Pure Strike Golf agree not to bring claims as part of a class action, collective action, private attorney general action, or representative action.
This section does not prevent either party from seeking relief in small claims court where permitted or from seeking injunctive relief for intellectual property misuse or unauthorized access.
This arbitration and class action waiver section should be reviewed by legal counsel before publication to ensure enforceability under applicable law.
23. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
24. Changes to These Terms
We may update these Terms from time to time. When changes are made, we will update the “Last Updated” date at the top of this page.
Continued use of Pure Strike Golf after changes are posted means you accept the updated Terms.
